1. Introduction & Acceptance
Welcome to Easy Verification! These Terms of Service (“Terms”) govern your access to and use of the Easy Verification website, services, and applications (collectively, the “Service”). The Service is provided by Easy Verification, Inc. (“we,” “us,” or “our”).
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization or entity (“Organization”), then you are agreeing to these Terms on behalf of that Organization, and you represent and warrant that you have the authority to bind the Organization to these Terms. In that case, “you” and “your” refer to you and that Organization.
If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Easy Verification provides a secure platform for income, employment, and asset verification. We act as an intermediary, enabling consumers to securely share their financial data with lenders, property managers, and other authorized third parties (“Lenders”) for verification purposes.
Our service is designed to streamline the verification process, making it faster, more accurate, and more secure for all parties involved.
3. Your Responsibilities
Accurate Information: You agree to provide true, accurate, current, and complete information about yourself as prompted by the Service’s registration or data-sharing forms.
Account Security: If you create an account, you are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account.
Compliance with Laws: You agree to use the Service in compliance with all applicable local, state, national, and international laws, rules, and regulations, including any laws regarding the transmission of technical data exported from your country of residence.
4. Lender-Specific Terms
These terms apply specifically to Lenders using the Service to verify consumer information. If you are a Lender, you agree to the following additional terms:
- Permissible Purpose: You certify that you will only request consumer information for a permissible purpose under the Fair Credit Reporting Act (FCRA) and other applicable laws. You will not use the information for any unlawful purpose.
- Consumer Consent: You must obtain explicit and verifiable consent from the consumer before using the Service to access their information. You are responsible for maintaining records of this consent.
- Data Security: You are responsible for safeguarding the consumer data you receive through our Service. You must implement and maintain reasonable security procedures and practices to protect the information from unauthorized access, use, modification, or disclosure.
- Adverse Action: If you take any adverse action against a consumer based in whole or in part on the information obtained through our Service, you are solely responsible for complying with all legal requirements, including providing the consumer with an adverse action notice.
- Compliance: You are solely responsible for ensuring your use of the Service complies with all applicable industry regulations and laws, including but not limited to FCRA, the Gramm-Leach-Bliley Act (GLBA), and Equal Credit Opportunity Act (ECOA).
Easy Verification acts as a conduit for information and does not make credit decisions. The accuracy and completeness of the consumer-provided data are not guaranteed by Easy Verification.
5. Prohibited Conduct
You agree not to misuse the Service or help anyone else to do so. This includes, but is not limited to, the following:
- Attempting to interfere with or compromise system integrity or security, or deciphering any transmissions to or from the servers running the Service.
- Taking any action that imposes an unreasonable or disproportionately large load on our infrastructure.
- Uploading invalid data, viruses, worms, or other software agents through the Service.
- Impersonating another person or otherwise misrepresenting your affiliation with a person or entity.
6. Data Privacy and Security
Your privacy is critically important to us. Our Privacy Policy explains how we collect, use, and protect your personal and financial information. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.
We implement industry-standard security measures to protect your information from unauthorized access, alteration, disclosure, or destruction.
7. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Easy Verification, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks may not be used in connection with any product or service without our prior written consent.
8. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL EASY VERIFICATION, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
9. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
12. Use of AI
By using this site and related services, you acknowledge that Easy Verification may employ supervised AI enabled features to enhance automation,
security, and operational efficiency, while maintaining human oversight for all transcript fulfillment decisions and compliance determinations,
including the ability to provide specific reasons supporting any credit related actions taken by our lender clients. Easy Verification will not
authorize the use of taxpayer or loan data to train generalized third party AI models and will continue to follow IRS, GSE, and government backed
lending requirements regarding confidentiality, permissible use, explainability, auditability, and protection of IVES and customer information.
